Obligation to Attend Court

After being charged with an offence such as impaired driving or driving over 80 mgs, you might be released with a “Promise to Appear.” This document includes important details about your first court date. It also states that you must appear in court and provide your fingerprints and photograph. If you fail to appear, an arrest warrant could be issued, leading to further charges and a possible custody hold until your trial. The first court date is for you to be formally informed of your charges and to receive disclosure such as the police report.

 

Attending Criminal Court

When the police release you pending a court date, you agree to appear in court on the specified date, time, and location. The Promise to Appear includes these details along with your fingerprint and photograph requirements. Missing this date could result in an arrest warrant. Sometimes, errors on the Promise to Appear can lead to the case not proceeding. If you have legal representation, your lawyer can often appear on your behalf, which can reduce errors and delays.

Initial Court Date – First Appearance

The initial court date, called a “First Appearance Date” or “Set Date,” is not a trial but a time to appear, be informed of the charges, and collect disclosure.
