When a person is charged with impaired driving by alcohol or a drug or refusing a breath demand in Ontario, an automatic 90-day administrative licence suspension is imposed by the Ministry of Transportation. If you decide to proceed to trial, the trial may not take place for 12 to 15 months from the time of arrest. Here’s how you can reinstate your licence after the initial 90-day suspension.

Steps to Reinstatement

  • Wait for the 91st Day:
    • Once the 90-day administrative licence suspension period is over, you can initiate the process of reinstating your licence.
  • Visit the Ministry of Transportation:
    • Go to your local Ministry of Transportation office on the 91st day to reinstate your licence.
  • Pay the Reinstatement Fee:
    • Pay the required reinstatement fee to lift the suspension and regain your driving privileges.
    • The fee amount may vary, and it’s advisable to check with the Ministry of Transportation for the current fees.
  • Receive Your Licence:
    • Upon payment, you will immediately receive your reinstated licence, allowing you to drive until your trial takes place.

Trial Outcome Implications

  • If You Win the Trial:
    • No further penalties or suspensions; you retain your driving privileges without additional consequences.
  • If You Lose the Trial:
    • If found guilty, additional suspensions, fines or jail time will apply, as discussed in related videos.

Legal Considerations

  • Consult with a Lawyer:
    • Before deciding on a trial or plea, consult with a legal professional to understand the potential outcomes and implications based on your specific case.
  • Adhere to Legal Procedures:
    • Follow all legal procedures, pay any necessary fees promptly, and stay informed about the status of your licence.

Conclusion

Understanding the process of reinstating your licence after a 90-day suspension is essential. Make informed decisions based on legal advice and consider your options carefully before proceeding with a trial or plea.

When you’re charged with impaired driving in the province you automatically get a 90 day administrative licence suspension right off the bat. So you can’t drive for 90 days. Let’s take the situation where you hire a lawyer and you decide to proceed to trial. The trial is not going to take place for 12 to 15 months at least from the time you were arrested. How do I get my licence back then is the situation. What you would do is on the 91st day you would go down to the Ministry of Transportation and pay a reinstatement fee and get your licence back and you can then drive right up until the point of your trial. If you win your trial that’s it. You’re not facing any further penalties. If you lose your trial, you are found guilty you are then going to be suspended. I discuss this in other videos about the length of suspension and fines you’re going to face in that particular situation. So that’s basically how you get your licence back and it’s up to you whether you want a trial or to plead guilty but this is for a situation where the 90 days has passed and how you get it back.
