The consequences of this offence range from an absolute discharge to up to 14 years in prison, depending on whether you are charged with simple assault, assault causing bodily harm, or aggravated assault. If you are arrested, one of two things will happen:

  • You will be held in jail until it is determined whether you should be released pending your guilty plea or trial.
  • You may be released with bail conditions allowing you to defend the charges while out of custody.

Going forward, a Crown attorney will decide how to prosecute your case. The most serious route is if the Crown elects by indictment, which means the maximum jail term is much higher compared to if they elect summarily.

As part of their investigation, the police will gather statements from the household members, take photographs, and gather any forensic evidence. The police will also look into a suspect’s criminal history. The police will then provide their complete investigative file to the Crown prosecutor, who will review this information to determine the direction that the prosecution will take.
